Criminal Rehabilitation

If you have been deemed criminally inadmissible to Canada due to past criminal convictions, you may need special permission to enter Canada such as a Temporary Resident Permit (TRP) or criminal rehabilitation.

What is rehabilitation?

Deemed rehabilitation

For crimes committed outside Canada if the maximum sentence for the equivalent offense in Canada is less than ten years and if more than ten years have passed since the sentence was complete, the individual may be deemed rehabilitated. This means they are not inadmissible to Canada and can enter Canada subject to the normal examination at the border.

Similarly, if an individual has committed two or more minor offenses outside of Canada which in Canada are called summary offenses and five or more years have passed since their sentence was completed they are also deemed rehabilitated. If an individual only has one summary conviction on their record they are not criminally inadmissible to Canada.

The visa officer has reason to believe the applicant has provided false information or documents in the application. For example if an applicant fails to disclose a previous visa refusal to another country such as the United States the result will be a finding of inadmissibility for misrepresentation and a ban of 5 years from Canada. Another common example of misrepresentation is failing to disclose facts about their criminal history on their application.
The visa officer is not convinced that a genuine or real relationship exists and may suspect that the relationship was entered into solely for the purpose of obtaining permanent residence status in Canada. This is known as a marriage of convenience.
The visa officer suspects or has evidence to believe that the applicant has committed or been convicted of a criminal offense in Canada or outside of Canada that would render them inadmissible to Canada meaning they would not be allowed to entry the country.
Applicants with a medical issue may be found medically inadmissible to Canada. This is common in family sponsorship cases especially those involving elderly family members.
Persons who have served in the military or in some government positions or who were members of certain organizations may be required to provide more information to IRCC about their roles and activities to determine if they are inadmissible to Canada for security reasons.
Visa officers can issue a PFL for a variety of reasons if they require more documentation or evidence about an area of an application.

Criminal rehabilitation vs (TRP)

The processing time for criminal rehabilitation applications is much longer than for TRP applications, withan average processing time for a criminal rehabilitation application of 18 months. However, the advantage of applying for criminal rehabilitation is that if you are successful in your application you will be allowed entry into Canada and your criminal inadmissibility will be removed for future entry. Therefore, provided you meet all the other requirements for entry into Canada you will be allowed to enter again in the future.

If you are ineligible to apply for criminal rehabilitation or need to enter Canada within a year or less and only need to enter Canada one time for a specific purpose a TRP might be a better option. A TRP is usually issued for the length of your visit to Canada—for example, one week to attend a conference. You must leave Canada by the expiry date of the permit or get a new permit before your current one expires. HOW CAN A REGULATED CANADIAN
